Securities and Exchange Commission v. Jarkesy. On Wednesday, the Supreme Court will hear a three-part case on the constitutionality of the Securities and Exchange Commission (SEC). Because of an unusual decision by the U.S. Court of Appeals for the 5th Circuit, the Supreme Court is going to be evaluating three distinct challenges to the SEC at the same time. The situation arose after the 5th Circuit ruled 2-1 in favor of three separate arguments, invalidating each aspect of the SEC's operations that were being challenged.
