Shmuel says the judges have the discretion to award as they see fit. The potential for financial involvement by the parties is also relevant. Also, establishing ownership by witnesses to one's possession (use) of the land. But what about a landlord/sharecropper situation? The owner has to make it clear that the renter's use of the land is not a case of presumptive ownership.
